IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A No. 261 of 2025 Manik Chalak ... Petitioner Versus Central Bureau of Investigation … Opposite Party --- CORAM: HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY For the Petitioner : Mr. Pratiush Lala, Advocate For the CBI : Mr. Anil Kumar, ASGI; Ms. Chandana Kumari, AC to ASGI Mr. Kumar Swapnil, AC to ASGI --- 02/20.01.2025 Heard Mr. Pratiush Lala, learned counsel for the petitioner and Mr. Anil Kumar, learned ASGI appearing on behalf of the CBI. The petitioner apprehends his arrest in connection with RC Case No. 42(S)/2017/EOW/Ranchi. It appears that the petitioner had earlier moved for grant of anticipatory bail in ABA No. 7283 of 2023 which however was dismissed on account of non-removal of the defects. Submission has been advanced by learned counsel for the petitioner that the petitioner is the Director of M/s Matribhumi Manufacturing & Marketing India Ltd. and M/s Matribhumi Mutual Benefit Ltd. It has been submitted that several co-accused persons similarly situated have been granted anticipatory bail by this Court in ABA No. 3174 of 2024 and ABA No. 6138 of 2024. Mr. Anil Kumar, learned ASGI, has opposed the prayer for anticipatory bail of the petitioner. The allegation reveals that the chit fund companies in which the petitioner was the Director was involved in duping the investors of huge amount of money and in spite of maturity the amount was not returned to them. However, since it appears that charge-sheet has been submitted and several co-accused persons who also appear to be the Director of M/s Matribhumi Manufacturing & Marketing India Ltd. and M/s Matribhumi Mutual Benefit Ltd. have been granted anticipatory bail by this Court, I am inclined to grant the privilege of anticipatory bail to the petitioner. -2- Accordingly, the petitioner is directed to surrender before the learned trial court within four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate-cum-Special Judicial Magistrate, CBI, Dhanbad in connection with RC Case No. 42(S)/2017/EOW/Ranchi, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023. This application stands allowed. S.B. (RONGON MUKHOPADHYAY, J.)
