No. 99 of 2010 which was dismissed for default vide order dated Patna High Court MJC No.767 of 2025(3) dt.11-04-2025 3/3 10.12.2024. 2. Learned counsel appearing for the applicants submits that on 10.12.2024, the instant appeal was listed under the heading “For Hearing” before this Bench but when the matter was called out, no one appeared on behalf of the appellants. It is further submitted that in the cause list dated 03.12.2024 and 10.12.2024, the name of appellants’ counsel was mentioned as ‘Rawti Kant Raman’ in place of ‘Rewti Kant Raman’ and due to that, neither in the email nor in the text message, the listing details has been received by the appellants’ counsel, due to which, the matter was not marked by appellants’ counsel, hence, no one could appear before this Court when the matter was called out and the matter was dismissed for default. It is further submitted that the said latches is on the part of the office of appellants’ counsel and there is no latches on the part of the appellants, and, if the original file, i.e., F.A. No. 99 of 2010 is not restored then the appellants will suffer an irreparable loss. 3. Having considered the above submissions, F.A. No. 99 of 2010 is restored to its original file. 4.
