By way of this petition, the petitioner has prayed for following reliefs:- “10.1This Hon'ble Court may be pleased to summon the entire record pertaining to the petitioner no. 01 departments. 10.2 That, this Hon'ble Court may kindly be pleased to set aside the arbitrary action of the respondents. 10.3 The Hon'ble Court may kindly be pleased to issue a writ or directions to give for compassionate appointment to the son of petitioner no. 01 ie. petitioner no. 02 Rajesh Kumar Nirmalkar in view of the case of the petitioner's case and as well as policy of the respondents for compassionate appointment. 3 10.4 Any other relief which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case of the petitioners, in the interest of justice. 10.5 Cost of the petition.” 2. Learned counsel for the petitioner, after presenting extensive arguments on the matter, respectfully seeks permission from this Honorable Court to withdraw the present petition. However, it is submitted that an appeal, duly filed by the petitioner and annexed as Annexure P/5 before the respondent authorities, remains pending and has not been adjudicated upon since the year 2019. In light of this, the petitioner humbly requests that this Court may kindly issue a direction to the respondents to expeditiously consider and decide the said appeal without any further delay, ensuring that justice is duly served in accordance with law. 3. On the other hand, learned counsel for the respondents submits that if the appeal is yet to be pending the same shall be dealt in accordance with law and all endeavors to be taken to decide the same within some stipulated period. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Considering the facts and circumstances of the case and further considering the fact that the petitioner has withdrawn the petition it is upon the respondent authorities to consider the same and to 4 decide the appeal within some stipulated period. 6.
