JUSTICE SUSMITA PHUKAN KHAUND ORDER 19.11.2025 Learned counsel Mr. A. Tatak is present for the petitioner, Smt. Oyong Tatin who has assailed the impugned termination order no. EED/121015/5/2023 dated 16.11.2023 issued by the Commissioner (Education) Department, Govt. of Arunachal Pradesh whereby the petitioner was terminated from her services as Multi Tasking Staff (MTS for short). 2. The petitioner was serving in the Office of the Government Higher Secondary School, Pessing. Now at this stage, a limited prayer has been made that this matter may be remanded back for consideration by the respondent no.1 as a representation by the petitioner dated 28.11.2023, praying for reinstatement is pending in the Office of the respondent no.1. 3. It is further submitted that in a similar matter in WPC no. 638(AP)/2023, the petitioner’s counterparts who have been terminated by the same order has also filed representations before the respondent no.1 and this Court in WPC No. 638(AP)/2023, vide order dated 07.11.2025, has remanded back the matter of 188 similarly situated petitioners to be considered by the Commissioner, respondent no.1. 4. Learned counsel Mr. R. Koyu is present on behalf of learned Standing Counsel Mr. Tagum for the Education Department and has fairly submitted that Page No.# 3/3 this matter may be remanded back and the petitioners representation may be taken up by the respondent no. 1 for consideration. 5. Upon perusing the materials and after considering the matter, it appears that based on the limited prayer, this petition may be disposed of as submitted by the learned counsel representing both the parties. Accordingly the respondent no. 1, being the Commissioner and Secretary, Education Department to the Government of Arunachal Pradesh, shall take up for consideration, the petitioners case and conduct the necessary verification regarding the nature of the appointments and based on the outcome of such a process, pass necessary speaking order in accordance to law, as early as plausible. The aspect of parity with similarly circumstanced persons shall be taken into account. The petitioners may submit a copy of this order before the respondent Authority. 6.
