The present application has been filed to quash the summoning order dated 28.05.2007 passed by learned Additional Chief Judicial Magistrate, Kasganj, Etah as well as entire proceedings of Case No.649 of 2020, arising out of Complaint Case No.98 of 2007, under Sections-498-A, 323, 504, 506, 406 IPC and Section 3/4 of Dowry Prohibition Act, Police Station- Kasganj, District-Kasganj, pending in the court of learned Civil Judge (J.D.)/Judicial Magistrate/F.T.C./Crime Against Women Prevention Act, Kasganj on the basis of compromise dated 28.07.2010. 3. At the very outset, learned counsel for the applicant has submitted that parties have settled their dispute amicably but he did not annexed the copy of compromise entered into between the parties regarding the impugned proceeding. Therefore, he may be permitted to withdraw this case so that he can file fresh Application u/s 528 of BNSS alongwith the deed of compromise in the impugned proceeding. 4. In view of the above, present application is dismissed as withdrawn with the aforesaid liberty.
