Also heard Mr. R.J. Baruah, learned Additional Public Prosecutor for the State of Assam. 2. This petition under Section 482 BNSS is filed by the petitioners, namely, (1) Abdul Rashid Ahmed @ Ranju (2) Rahmatulla @ Rahmatulla Ali, apprehending arrest in connection with Noonmati P.S. Case No. 228/2025 (corresponding to GR No. 5692/2025) registered u/s 126(2)/117(2)/74/76 / 109(1)/3(5) of BNS. 3. The gist of allegation in the ejahar is that while informant was going, the accused persons named in the FIR started altercation and they assaulted him and there was also an act of tearing the cloths of his wife and giving blow on her head. 4. Case diary is received. 5. Apart from the bail objection, strongly contended for Page No.# 3/4 rejection of bail by the I.O, it is also submitted by the learned Public Prosecutor that though investigation has stated about all the accused persons asssaulting but the main implications about assault is against Ramjan Ali. 6. It is also submitted that the materials are found that both the husband (informant) and wife, who are the victims sustained grievous injuries. 7. In view of the aforesaid facts and circumstances, perhaps, it may not be essential to cancel the interim bail granted to the petitioner no.1 and 2. 8. Accordingly, the order of pre-arrest bail dated 05.01.2026 is hereby made absolute subject to the conditions : i) shall cooperate with the remaining investigation; ii) shall not hamper or tamper with the evidence; iii) shall not intimidate or harm the informant/victim in any manner; iv) shall not misuse their liberty to commit any illegal activities and offence; 9.
