---- 2/28.08.2025 The petitioner is apprehending his arrest in connection with Nirsa PS Case No.109 of 2025 registered for the offence under section 274, 275 of BNS, 2023 and section 47(a), 47(b), 52(d), 55 of Excise Act, pending in court of learned Judicial Magistrate, First Class, Dhanbad.
2. Learned Senior counsel appearing through Video Conferencing for the petitioner submits that the allegations are there however the co-accused person has been granted anticipatory bail in ABA No.4363 of 2025.

Learned counsel for the State submits that the case of the petitioner is not identical to the person who has been granted anticipatory bail and from the house of the petitioner liquor of 496 bottle have been recovered. He submits that in the impugned order it has come that four criminal antecedents are there against the petitioners of similar nature.

In view of above, it transpires that two persons have been granted anticipatory bail considering that liquor in question has been recovered from the house of this petitioner and in view of that, the case of the petitioner is not identical and further the petitioner is having four criminal antecedents of similar nature, and in that view of the matter, I am not inclined to grant anticipatory bail to the petitioner. Hence, the prayer of the petitioner for grant of anticipatory bail is, hereby, rejected.
5. This petition is dismissed.
