Neutral Citation No. - 2025:AHC:135793 Court No. - 5 Case :- WRIT - A No. - 5696 of 2002 Petitioner :- Rajesh Rai L.D.C. Respondent :- Union Of India Thru Secy. Ministry Of Shipping And Others Counsel for Petitioner :- Ripu Daman Singh,P.D.Singh,Rakesh Pandey,Ram Pravesh Yadav,Shashank Kumar,Vishakha Pande Counsel for Respondent :- S.C.,Ashok Khare,Bal Mukund,S.D. Shukla Hon'ble Saurabh Shyam Shamshery,J. The petitioner was admittedly appointed as on Ad-hoc basis on the post of L.D.C. and an extension was also granted, however, by an
order dated 21.07.1997, the extension beyond 11.06.1997 was not approved and accordingly, his services were terminated. Thereafter a requisition dated 22.07.1997 was issued for fresh recruitment. Initially, an application challenging the impugned termination was filed before the Central Administrative Tribunal, however, it was rejected on ground of jurisdiction. Thereafter in the year 2002, present writ petition was filed against order of termination and against order of requisition. No stay order was granted and this writ petition remained pending for more than two decades. The outcome of requisition is not on record, however, in all probability, the new selection process must have been concluded and selected candidates must have been working. Selected candidates are not party respondent, therefore, much water has flown after this writ petition was filed otherwise also, the Court is of opinion that an order whereby Ad-hoc appointment was not extended is not an order which could be interfered under writ jurisdiction. In the aforesaid circumstances, the relief sought cannot be granted. Accordingly, writ petition is dismissed.
