ORDER 13.11.2025 Heard Mr. Lalbiaknunga Hnamte, learned counsel for the applicant who has filed this application u/s 5 of the Limitation Act R/W Order XLI Rule 3A of the CPC for condonation of a delay of 43 days in preferring the connected appeal against the impugned order dated 02.04.2025 in Civil Suit No. 26 of 2014 passed by the learned Civil Judge (Senior Division)-VI, Aizawl. The learned counsel for the applicant submits that, the reason for the delay of 43 days was not due to negligence on the part of the applicant and the delay has been explained in detail at para 4 (I) – (V) of the application, which is due to the time taken for engaging a counsel to represent the applicant and also for obtaining the necessary document. Mrs. Mary L. Khiangte, learned Govt. Advocate for the State respondents submits that they have no objection to the condonation of the delay as prayed for. On hearing the submissions made by the learned counsel for both the parties, this court has perused the explanation given at Para 4, (I) – (V) of
Page No.# 3/3 the application and find that the explanation given by the applicant for the delay is reasonable and acceptable. In view of the above, this court being satisfied with the explanation given by the learned counsel for the applicant find it appropriate to condone the delay of 43 days in filing the connected Regular First Appeal against the
Judgment & Order dated 02.04.2025, passed by the Civil Judge (Senior Division)-VI, Aizawl District in Civil Suit No. 26 of 2024. Accordingly I.A (Civil) No. 134/2025 stands allowed and disposed of.
