ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: -
“To issue an appropriate writ or any other order or direction particularly one in the nature of writ of mandamus declaring the action of the 4th respondent in issuing the impugned endorsement vide Rc. No. B/20/2025 dt. 24.02.2025 in respect of the lands of the petitioner/s being an extent of Ac.5.80 cents in Sy. No. 1242 situated at Somireddy Palle Revenue Village, B Matam Mandal, YSR Kadapa District as illegal, arbitrary, violation of articles 14, 21 300-A of Constitution of India, violation of principles of natural justice and contrary to the provisions of the A.P. Rights in Land and Pattadar Pass Books Act 1971 and rules made thereunder and consequently set aside the same and pass such other order. ” Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents.

Learned counsel for the petitioner submits that the petitioner owner and possessor of agricultural land admeasuring to an extent of Ac.6.21 cents in Sy.No.1242 situated at Somireddypalle Revenue village, B.Matam Mandal, YSR Kadapa District, having acquired the same through his ancestors. The of the petitioner’s ancestors are reflected in RSR and other relevant records in respect of subject land. After the demise the petitioner’s ancestors, the petitioner has been in possession and enjoyment of the subject property. The learned counsel for the petitioner further

submits that the land Acquisition authorities acquired some land for the purpose of excavation of canal out of the subject property now, the petitioner is holding land to an extent of Ac.5.80 cents only. The learned counsel for the petitioner further submits that the mother of petitioner by name B.Venkatamma approached the 4*'^ respondent by way of application dated 16.12.2024 for mutation of petitioner’s name in the revenue record and for issuance of pattadar pass book and title deed in respect of subject property, however, the 4*'^ respondent without there being any notice and contrary to the procedure prescribed under law, erroneously issued an endorsement vide Rc.No.B/20/2025, dated 24.02.2025 holding that the subject land was sub-divided and part of the land is classified as field channel, rest of the land was held by the other pattadars. Therefore, for consideration of the claim of the petitioner, the matter was placed before the R.D.O. for appropriate orders, but till now, the 3'^ respondent/R.D.O neither considered the representation of the mother of petitioner nor passed any orders. On the other hand, the learned Assistant Government Pleader for Revenue submits that pursuant to the report submitted by the 4*'^ respondent dated 24.02.2025, the 3^^ respondent will consider the representation of the petitioner and pass appropriate orders as per the record available with them as per law. as of

6. Considering the submissions made by both the
learned counsel and on perusal of the material on record, this Court deems it appropriate to dispose of the writ petition directing the 3'^ respondent herein to consider the report of 4*^ respondent dated pass appropriate orders within a period of three months from the date of receipt of copy of this order by providing hearing to the petitioner and other accordance with law. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
