WA No. 1292 of 2025 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 23-04-2025 CORAM THE HONOURABLE MR. JUSTICE S. M. SUBRAMANIAM AND THE HONOURABLE MR. JUSTICE K. RAJASEKAR WA No.1292 of 2025 and C.M.P.Nos.9824 & 9827 of 2025 1. M/s.Meenakshi Exports (Vellore) Pvt Ltd., Rep by its Director K.Parameshwaran, Plot No.11, SIPCOT Industrial Estate, Lalapet Road, Ranipet, Walajah Taluk, Vellore Dt. Appellant(s) Vs 1. The Tamil Nadu Industrial Investment Corporation Ltd., (TIIC) Rep by its Branch Manager, No.45, T.K.M. Complex, II Floor, Katpadi Road, Vellore 4. 2.State Industries Promotion of Tamil Nadu (SIPCOT) Rep by its Chairman and Managing Director, 19-A, Rukmani Lakshmipathy Road, Egmore, Chennai 8. Respondent(s) https://www.mhc.tn.gov.in/judis WA No. 1292 of 2025 PRAYER: To set aside the order dated 02.09.2024 made in WP No.17235 of 2010 passed by this Hon'ble Court by allowing this Writ Appeal. For Appellant(s): Mr.T.N.Rajagopalan for Mr.K.S.Ravikumar ORDER (Order of the Court was made by S.M.Subramaniam J.) The present intra court appeal has been instituted challenging the writ order dated 02.09.2024 in W.P.No.17235 of 2010. 2. The writ petitioner is the appellant before this Court. Writ proceedings was instituted challenging the letter issued by State Industries Promotion Corporation of Tamil Nadu Limited dated 08.08.2006. 3. Perusal of the letter reveals that the appellant submitted an application seeking NOC and transfer of lease hold rights in the name of M/s. Meenakshi Exports (Vellore) Private Limited. On examination, the respondents declined to grant NOC on the ground that the appellant has to remit a sum of Rs.28.43 lakhs towards the differential land cost. https://www.mhc.tn.gov.in/judis WA No. 1292 of 2025 4. Such a letter of intimation issued by the respondent would not provide any cause for institution of writ proceedings. The contractual obligations between the parties are to be determined by way of an adjudication based on the documents and evidences and the terms and conditions agreed between the parties. Such an endeavour cannot be undertaken by the writ Court in exercise of the powers of judicial review under Article 226 of the constitution of India. 5. Thus, the writ petition per se is not entertainable since the issues are relating to contractual obligations between the parties. Thus the writ Court rightly rejected the writ petition and consequently, the writ appeal stands dismissed. There shall be no order as to costs. Consequently, the connected miscellaneous petitions are also stands closed. (S.M.SUBRAMANIAM J.)
