-2- 10.2 Any other relief or relief(s) which this Hon'ble Court may deem fit and proper in view of the facts and circumstances of the case, may also kindly be granted.” 2) The present writ petition is filed seeking a direction to the learned II nd Additional Principal Judge, Family Court, Bilaspur (C.G.), to expedite the proceedings in the petition filed by the petitioner under Section 13(1A) of the Hindu Marriage Act,
1955. 3) Mr. Gupta submits that the petitioner initially filed a petition under Section 13(1A) of the Hindu Marriage Act, 1955 before the learned Ist Additional Principal Judge, Family Court, Indore (M.P.), bearing No. HMA 664/2023. The same was transferred to the Family Court, Bilaspur (C.G.) pursuant to the Hon'ble Supreme Court’s order dated 02.01.2024 in Transfer Petition No. 2962/2023. On receipt of the record, the case was registered as C.S. No. 95A/2024 before the Principal Judge, Family Court, Bilaspur, and matter was fixed for appearance on
09.04.2024. Subsequently, it was listed on 06.12.2024 for evidence, the petitioner submitted his statement under Order 18 Rule 4 CPC. Thereafter, the matter has been adjourned several times due to non-appearance of the respondent/wife.
4) He would further submit that on 21.03.2025, the learned Court below granted last opportunity to the respondent and fixed the case for petitioner’s evidence on 26.04.2025, but on said date the respondent did not appear and sought exemption from appearance; thereafter, the learned Court below adjourned the matter for 10.06.2025 for appearance and petitioner’s evidence; thus, he prays
-3- that the learned Court below may be directed to expedite the proceedings of C.S. No. 95A/2024 (Sudesh Vs. Rashmeet). 5) Considering the submissions made by Mr. Gupta, the writ petition is disposed of with a direction to the learned Court below to make all endeavours to conclude the proceedings of C.S. No. 95A/2024 (Sudesh Vs. Rashmeet) expeditiously, preferably within a period of six months, in accordance with law. 6) With the aforesaid observation(s) and direction(s), this writ petition is disposed of at the motion stage itself.
