Premchand Jyani S/o Hanumanaram, Aged About 31 Years, R/o Behind Sonu Monu School, Muktaprasad Nagar, Police Statoin Mukta Prasad Nagar, District Bikaner, (Currently In Judicial Custody At Jaipur Central Jail) ----Petitioners Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Angad Haksar For Respondent(s) : Mr. S.R. Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 17/01/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.66/2024 registered at Police Station- Special Police Station (SOG), District ATS and AOG for the offence(s) under Sections 420, 467, 468, 471 & 120-B of IPC and Sections 3, 4, 6 and 10 of Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the charge-sheet against the accused- petitioners had already been filed. The accused-petitioners are in [2025:RJ-JP:2450] (2 of 3) [CRLMB-593/2025] custody since long and trial/investigation of the case may take considerable time, therefore, the bail application of the accused- petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that the accused-petitioners were members of the syndicate who were involved in facilitating the answers to the candidates who appeared in the examination conducted by the RPSC for the post of Revenue Officer Grade-II, through their Sim. The offences against the accused-petitioners are grave, therefore, the bail application of accused-petitioners may be dismissed. 4. Heard and perused the material available on record. 5. It is not desirable to express anything on the merits of the case. Considering the fact that the charge-sheet itself is voluminous and the list of the witnesses filed by the prosecution contain 90 witnesses. The accused-petitioners are in custody since long and trial/investigation of the case may take considerable time, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners namely: 1. Omprakash Jakhad S/o Bhagwanaram Jakhad and 2. Premchand Jyani S/o Hanumanaram in connection with FIR No.66/2024 registered at Police Station- Special Police Station (SOG), District ATS and AOG shall be enlarged on bail provided they furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial [2025:RJ-JP:2450] (3 of 3) [CRLMB-593/2025] Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
