Date : 13/06/2025 ORAL ORDER When the matter is called out, learned advocate for the petitioner is not present. Present petition under Articles 226 and 227 of the Constitution of India is filed seeking following reliefs:
“A) YOUR LORDSHIPS may kindly be pleased to direct the Ld. Additional Chief Metropolitan Magistrate, N.I. Court No.34, Ahmedabad to accept the bail bond of the applicant herein alongwith the surety of the like amount as the same is not required to be furnished within a period of 60 days in the interest of justice; B) YOUR LORDSHIPS may kindly be pleased to call for record and proceedings of Criminal Appeal No.274 of 2023, from the Court of Ld. Addl. Sessions Judge, City Sessions Court, Ahmedabad and further be pleased to quash and set aside the said order passed by the court below Exh.4 dated 09.10.2023 to the extent it directs the applicant to deposit 20% compensation amount;” With the assistance of learned APP appearing for the
R/SCR.A/3578/2024 ORDER DATED: 13/06/2025 respondent – State and perusing the record it appears that petitioner has requested this Court to exercise powers under Articles 226 and 227 of the Constitution of India. However, in view of decision of Hon’ble Supreme Court in the case of Jamboo Bhandari vs. Madhya Pradesh State Industrial Development Corporation Limited and Ors. reported in (2023) 10 SCC 446 as well as Muskan Enterprises and Anr. vs. State of Punjab & Anr. reported in 2024 INSC 1046, no case is made out to entertain the present petition in exercise of powers under Articles 226 and 227 of the Constitution of India and hence, present petition is dismissed. In view of dismissal of SCR.A No.3578/2024, Criminal Misc. Application No.1/2024 in SCR.A No.3578/2024 also stands dismissed. (HASMUKH D. SUTHAR, J.)
