CMP(M) No. 1618/2024 The present application under Section 5 of the Limitation Act has been filed by the applicants for condoning the delay in filing the present appeal. The application is duly supported with the affidavit of one of the applicants. No reply to the application is intended to be filed on behalf of the non-applicants/respondents, however,
learned
counsel
for
the
non- applicants/respondents has opposed the prayer made in the application on the ground that the applicants have not explained sufficient reasons to condone the delay. Heard. In the opinion of this Court, the delay has been sufficiently explained, which was neither willful nor deliberate but was beyond the control of the applicants, as such, deserves to be condoned. Consequently, Having regard to the averments made in the application, the same is allowed and delay of 173 days that has occurred in filing the appeal, is condoned. The application stands disposed of.
