Jyotsna Rewal Dua, Judge Even though the respondents have not filed reply, however, with the consent of learned counsel for the parties, matter is heard at this stage. 2. This writ petition has been filed for grant of following substantive reliefs:- “i That writ of mandamus may kindly be issued, directing the respondents to give regularization to the petitioner against the posts of Language Teacher on completion of 3 years continuous 1 Whether reporters of Local Papers may be allowed to see the judgment? yes - 2 - contractual service from the due date i.e. January, 2018 in terms of the policy dated 04.05.2017 (Annexure P-2) & policy dated 11.05.2018 (Annexure P-3) with all consequential benefits including seniority from the due date. (ii) That writ of mandamus may kindly be issued, directing the respondent authorities to decide the representation of the petitioner dated 18.12.2020 (Annexure P-5) within a time bound manner by taking into consideration regularisation policy dated 04.05.2017 (Annexure P-2) & policy dated 11.05.2018 (Annexure P-3).” 3. Learned counsel for the petitioner submits that the relief prayed for and the legal issue involved in the case has already been adjudicated upon in Yashwant Singh and Ors Vs. State of HP and Anr2. Learned counsel for the petitioner further submits that petitioner would be satisfied in case she is permitted to make a representation to respondent /Competent Authority for the redressal of her grievances, whereafter, respondent /Competent Authority be directed to consider his representation within a time bound schedule. Learned Additional Advocate General has no objection for the same. 4. Having regard to the aforesaid submissions, this writ petition is disposed of by permitting the petitioner to 2 CWP No. 342 of 2021, decided alongwith connected matters on 31.08.2022 - 3 - prefer a representation to respondent /Competent Authority within two week, the same shall be considered and decided by the Competent Authority, in accordance with law, keeping in view decision rendered in Yashwant singh2, within a period of six weeks thereafter. Copy of decision so taken, be communicated to the petitioner. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
