Heard the parties.
The petitioner has been made accused in connection with Satbarwa P.S. Case No. 119 of 2024, S.T. Case No.74 of 2025, for the offence under Sections 190, 191, 126, 127, 115, 117, 118 & 109(1) of B.N.S., 2023 and subsequently, Section 103(1) of the B.N.S has been added but charge has been framed under Sections 190, 191(2), 191(3), 126(2), 127(2), 115(2), 117(2), 118(1), 118(2), 103(1), 109(2) & 61(2)A of the B.N.S., pending in the court of learned Additional Sessions Judge-I, Palamau.
On 02.10.2024, at about 08:00 a.m., accused persons are alleged to have assaulted the parents of the informant, due to which, the father of the informant succumbed to his injuries.
It was submitted that there is general allegation against the petitioner. It was further submitted that there is specific allegation against co-accused Sakendra Uraon, Ravindra Bhuiyan and Pappu Bhuiyan to have assaulted the deceased and the mother of the informant. It was finally submitted that several co-accused persons have been granted bail by this Court earlier.
Learned counsel for the informant has vehemently opposed the prayer for bail and submitted that apart from main accused person who had
-2- assaulted the deceased, there is general allegation against all the accused persons to have assaulted by deceased with lathi. It was further submitted that co-accused persons had also severed the fingers of the mother of the informant.
Considering the fact that there is general allegation against the petitioner and also the fact that similarly situated co-accused persons have been granted bail earlier, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I, Palamau, in connection with Satbarwa P.S. Case No. 119 of 2024, S.T. Case No.74 of 2025.
