This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-
“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the 4th respondent in initiation of the proceedings and disposal of the petitioner’s representations dated 25.04.2025 and 02.05.2025 requesting to comply his undertaking in Award in Pre-Litigation Case No.07/2022 dated 10.05.2022 before the Lok Adalat Bench at Nandikotkur as illegal, arbitrary, unjust, violation of fundamental rights guaranteed under Article 19, 21 and consequently direct the 4th respondent to initiate proceedings and dispose of the petitioner’s representations 25.04.2025 and 02.05.2025 by complying his undertaking in Award in Pre-Litigation Case No.07/2022 dated 10.05.2022 before the Lok Adalat Bench at Nandikotkur and pass such other order.”
2. Heard the learned counsel for the petitioner and learned Government Pleader for the respondents. 3. Learned counsel for the petitioner submits that there is an award passed by the Lok Adalat on 10.05.2022 with the consent of respondent Nos.3 and 4, under which respondents assured the petitioner’s society to provide the government land admeasuring to an extent of Ac.0.50 cents at Nandikotkur Village. Even though the consent award was passed on 10.05.2022, the respondents neither adhered to the consent award nor submitted any other proceedings

or initiated any suitable steps to protect the interest of the petitioner’s society. 4. On the other hand, learned Government Pleader furnished written instructions dated 11.07.2025 issued by the 4th respondent, wherein it is categorically stated as follows:
“I further submit that as per revenue records as per RSR the said Sy.No.410 with an extent of 316.59 is classified as Government Land (Grazing Ground) and the same has been included in 22(a)(1)(b) register.
Vide in the reference 2nd cited, as per B.S.O 15(3)(4)(ii) “(a) The assignment of the following classes of lands in prohibited:- (a) Poramboke take-beds, fore-shore of tank-beds cattlestands, grazing lands and reserved lands )reserved for depressed class members or for any public purpose, such as schools, play grounds, hospitals, maternity centres, reading rooms, extension of house sites, panchayat purposes, town sites and lands in proximity thereof.” In view of the above the plea of the plaintiff i.e., the land in Sy.No.410 to an extent of Ac.1.50 cents within limits of Nagatoor Village of Nandikotkur Mandal to be allotted in favour of Sri M.Srinivasulu is not possible as the said survey number is classified as Government Land (Grazing ground) and it is under prohibited property list under 22(a)(1)(b) and B.S.O 15(3)(4)(ii) of Nagatoor Village of Nandikotkur Mandal, with regard to pre- litigation case No.7/2022 the then Tahsildar, Nandikotkur has assured to send the proposals of Ac.0.50 cents of land to Government to allot the site to

the petitioner, as verified from the Revenue Records Ac.0.50 cents of Government land is not available in the Village. Hence, I request that the petition filed by the Sri M.Srinivasulu is baseless and it may kindly be rejected.”
5. Learned Government Pleader for the respondents further submits that the subject lands in Sy.No.410 are classified as grazing lands. Therefore, the same cannot be converted and cannot be alienated as such the request of the petitioner was rejected. 6. In view of the facts and circumstances as stated above, the Writ Petition is disposed of. The petitioner is at liberty to proceed further by initiating appropriate legal proceeding challenging the rejection order of the respondents and violation of the consent award by the respondents. There shall be no order as to costs. As a sequel miscellaneous application, pending, if any, shall also stand closed. ________________________________
