The present writ petition has been filed with the following prayer: "(i). issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 04.01.2024 passed by Sub-Divisional Magistrate, Tehsil Dataganj, District Badaun/Respondent No.2 (Annexure No.10 to the writ petition), whereby the agreement of fair price shop of the petitioner of village saray, Post-Pastaur, Tehsil-Dataganj, District Badaun has been cancelled. (ii) issue a writ, order in the nature of mandamus directing the Sub-Divisional Magistrate, Tehsil Dataganj, District Badaun/Respondent No.2 to restore the license/agreement of fair price shop of the petitioner of village saray, Post- Pastaur, Tehsil-Dataganj, District Badaun." 3. Learned counsel for the petitioner submits that he may be permitted to withdraw the present writ petition with liberty to file an appeal. 4. Accordingly, the present writ petition is permitted to be withdrawn with liberty to petitioner to file an appeal within 30 days from today.
