Heard learned counsel for the petitioner; Shri Madan Kumar Tiwari, learned counsel for the opposite party no.5, Shri Kamlesh Kumar Tiwar, learned counsel for the opposite party no.4 and learned A.G.A. Petitioner has approached this court praying for following relief:- "(i) Issue a writ, order or direction in the nature of mandamus directing and commanding to respondent no.2/ Police Commissioner (Commissionerate) Prayagraj, District Prayagraj to take necessary and legal action upon the application of the petitioner dated 6.1.2025, pending before him within stipulated period. (ii) Issue a writ, order or direction in the nature of mandamus directing and commanding the respondent no.3, Station House Officer, Police Station, Handia, District, Prayagraj to register the First Information Report against respondent no.4 to 6, in respect of incident as mentioned in the application of the petitioner within stipulated period." Learned counsel for the respondent nos. 4 and 5 pointed out that there is prior litigation between the parties. Other sides have also lodged First Information Report against the petitioner. The writ petition is disposed of granting liberty to the petitioner to approach the C.J.M. concerned under section 175(3) B.N.S.S. with regard to aforesaid relief.
