Order on Board 14.07.2025
1. The petitioner has filed this petition seeking the following reliefs: SMT NIRMALA RAO
-2- 10.1 The Hon'ble Court may kindly be pleased to call for the entire records pertaining to this case from possession of the respondents for it's kind perusal; 10.2 The Hon'ble Court may kindly be pleased to issue a suitable writ, order or direction and quash the impugned letter/order dated 20.11.2017 (Annexure P/1) issued by the respondent no.2; 10.3 The Hon'ble Court may kindly be pleased to issue a suitable writ, order or direction commanding the respondents to include the name of the petitioner in the list of eligible candidates prepared for selection on the post of Vehicle Driver; and 10.4 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner.”
2.
Learned counsel for the petitioner would submit that the petitioner participated in the selection process for the post of Vehicle Driver pursuant to an advertisement dated 1.7.2016. She would submit that the petitioner has passed the Class-X examination and holds a valid driving license. She would submit that the application form submitted by the petitioner was scrutinized, and lists of eligible and ineligible candidates were prepared, with objections invited thereafter. She would contend that the name of the petitioner appeared in the list of ineligible candidates and he failed to produce the required experience certificate and therefore, his candidature was rejected. She would submit that the petitioner possessed the requisite experience certificate, due to
3 inadvertence, it was not annexed with the application form, and he was not permitted to place the document on record at the time of
consideration of objections. She would submit that the respondent authorities have committed an error of law by declining to accept the experience certificate subsequently. She would pray to allow this petition and to quash the order dated 20.11.2017.
3. I have heard learned counsel for the petitioner at length.
4. A perusal of the documents and the impugned order dated 20.11.2017 reveal that the petitioner failed to submit the requisite experience certificate alongwith the application form. While he made attempt to submit the document when objections were invited but it was not permitted. As on the date of submission of the application form, the petitioner was not having required experience certificate, therefore, the respondent authorities justified while rejecting the candidature of the petitioner. I do not find any good ground to interfere with the order dated 20.11.2017. Accordingly, this petition fails and is hereby dismissed. SD/-
