THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO CIVIL REVISION PETITION NO: 1644 of 2025 ORDER: The present Civil Revision Petition is filed under Article 227 of the Constitution of India seeking to direct the trial Court to dispose of the suit vide O.S.No.161 of 2021 on the file of learned Principal Junior Civil Judge, Markapur, Prakasam District, which was filed to grant permanent injunction restraining the defendants, their men and agents in the suit from ever interfering with the suit schedule property. 2. The Hon’ble Apex Court directed the trial Courts to identify and dispose of cases on priority in which persons above 65 years of age are involved. These include long pending cases of Senior Citizens, pensioner and retired Government employees on a priority basis. 3. In the instant case, the petitioner, who is 1st defendant in the suit, is 65 years old suffering with bran related diseases and other old aged ailments and as there is acute urgency involved for disposal of the suit, keeping the suit pending may deprive him from enjoying the fruits of the decree. 4. This Court consistently receives numerous petitions under Article 226 and 227 of the Constitution of India to dispose of representations, applications, appeals, and suits filed under the provisions of the Act. The mechanical issuance of directions in such Civil Revision Petitions and Writ Petitions prejudices other aggrieved persons, who have been waiting for years. Granting priority or preference to one aggrieved person, would infringe the rights of others who are

also seeking redressal. Therefore, such discrimination must be avoided under all circumstances by treating all aggrieved persons equally and by considering their cases in the order of seniority. 5. No doubt, in certain cases urgency may be imminent. This court emphasizes that speedy disposal of a case sometimes leads to a quality order. If a senior citizen files a petition requesting priority for their case, the Court should grant priority and accordingly dispose of applications, suits, and appeals, even among other senior citizens. Cases involving senior citizens should be given priority, regardless of who the senior citizen is. This is because Courts in India are mandated to provide early disposal of cases involving senior citizens to ensure they receive justice in their lifetime. 6.
Therefore, the trial Court is hereby directed to disposal of the suit vide O.S.No.161 of 2021 on the file of learned Principal Junior Civil Judge, Markapur, Prakasam District, on priority basis, as expeditiously as possible, without granting unnecessary adjournments to both the parties. 7. With the above direction, the Civil Revision Petition is disposed of. There shall be no order as to costs.
