Respondent(s) (Cause Title is taken from Case Information System) -6- For Petitioners : Mr. Shobhit Mishra, Advocate For Respondent No.1 : Mr. Anup Majumdar, Advocate with Mr. Vibhor Goverdhan, Advocate For State : Mr. Pramod Shrivsatava, Deputy Government Advocate Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 14.07.2025 1) The petitioners have filed this petition seeking the following relief(s):- “10.1 That the Hon'ble Court may be please to the direct Respondents to make payments of the areas of Dearness Allowance from 01.01.1998 till date of retirement, voluntarily retirement or up to 31.07.2007 as case may be. 10.2 That any other relief, which this court may deem just in the circumstances of the case, is awarded to the petitioner including the cost.” 2) Mr. Mishra would fairly submit that except for petitioners No.1, 4, 37, 39 & 40, all other petitioners had opted for voluntary retirement prior to 31.12.2002. He submits that after the said date, 37 petitioners continued to work for a period of one month, but the salary and Dearness Allowance (for short, DA) for that month has not been paid to them. 3) With respect to the remaining five petitioners, Mr. Mishra submits that they continued to work even after 31.12.2002, and no DA was paid to them by respondent No.1 up to 31.07.2007. He further contends that MPSRTC has already cleared the balance DA payable to the petitioners. -7- 4) Mr. Mishra further submits that the issue involved in the present case has already been settled in the case of G.K. Gupta & Others v. Managing Director & Another, decided in WPS No.7123 of 2018. He, therefore, prays for a direction to be issued to respondent No.1 to release the DA payable to the petitioners post 31.12.2002. 5) Mr. Anup Majumdar, learned counsel appearing on behalf of respondent No.1, does not dispute the facts as narrated by Mr. Mishra. 6) Mr. Majumdar submits that while it is true that the petitioners have not been paid DA after 31.12.2002, their claims will be considered by the department. He states that if the petitioners submit representations before respondent No.1, the concerned authority shall consider and decide the same strictly in accordance with law. 7) Mr. Pramod Shrivastava, learned Deputy Government Advocate appearing for the State, supports the submission made by Mr. Majumdar. 8) Heard learned counsel for the parties and perused the documents. 9) It is admitted that the petitioners continued in service after 31.12.2002, and accordingly, the liability to pay DA rests with respondent No.1. A direction in this regard has already been issued in the matter of G.K. Gupta (supra). 10) Taking into consideration the submissions made by learned counsel for the parties, the directions issued in the matter of G.K. Gupta (supra), and the facts of -8- the present matter, this petition is disposed of with liberty reserved in favour of the petitioners to submit representations before respondent No.1 and in turn, respondent No.1 is directed to consider and decide such representations in the light of the judgment rendered in G.K. Gupta (supra) and pass an appropriate order in objective manner within a period of 60 days from the date of receipt of such representation. 11) With the aforesaid observations and directions, this writ petition stands disposed of.
