CORAM :THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICER RAGHUNANDANRAO DATE : 3rd July 2025 PC : The present petition is filed challenging the proceedings under the SARFAESI Act, 2002, initiated by respondent Nos.3 & 4 with regard to the property which the petitioner claims belong to him.
2. It is not denied that there was a General Power of Attorney executed by the petitioner in favour of respondent No.5 to alienate the property in question to third properties, who obtained loans and defaulted subsequently leading to the initiation of proceedings under the SARFAESI Act, 2002, against them.
3. The case set up by the petitioner before us is that SARFAESI proceedings cannot be permitted to continue inasmuch as fraud was played
2 HCJ & RRRJ W.P.No. 16584 of 2025 upon the petitioner by his General Power of Attorney holder, who had represented the General Power of Attorney as an Agreement to Sell.
4. We see that at least the petitioner No.1 is a doctor and therefore the assertion that the petitioner believed the document to be one not as that of a GPA but an Agreement to Sell does not satisfy us.
5. in any case, the issues of fraud etc. involving the disputed questions of fact cannot be gone into the present writ proceedings. The petitioner also appears to have filed a civil suit which is still pending in regard to the sale conducted by respondent No.5 in favour of respondent Nos.6 & 7.
6. Be that as it may, the petitioner having already proceeded to avail the alternate remedies, we do not think it is a fit case to invoke extraordinary jurisdiction under Article 226 of the Constitution of India. This petition is found to be without any merit and is, accordingly, dismissed. No costs. our Consequently, connected miscellaneous applications, if any, shall stand closed.
