The Police Notice dated 01.07.2021 issued by the Police Inspector, BMTF Police Station - second respondent vide Annexure-D is called into question in this Writ Petition on several grounds as set-out in the Memorandum of Writ Petition. 3. Heard the arguments and perused the Writ papers with care. 4. AGA submits that the Police Inspector, BMTF Police Station has power to issue notice. The oral submission made by AGA is placed on record. 5. The Police Notice is furnished along with the Writ Petition and the same is marked as Annexure-D. A perusal of the same reflects that the Police Inspector, BMTF Police Station has made certain allegations against the petitioner that he has - 3 - NC: 2025:KHC:840 WP No. 12890 of 2021 violated BBMP bye-laws and has not left the set-back. There is nothing on record to show that there is a violation of BBMP bye-laws and not leaving the set-back. Moreover, the authority concerned has acted beyond its authority. Hence, the Police Notice is liable to be set-aside and so, it is set-aside. 6. The Writ of Certiorari is ordered. The Police Notice dated 01.07.2021 issued by the Police Inspector, BMTF Police Station - second respondent vide Annexure-D is quashed. 7. Resultantly, the Writ Petition is allowed.
