Learned counsel for the petitioner submits that this interlocutory application has been filed with the prayer to delete the Opp. Party no. 2 - Suresh Kumar Murmu who was complainant of the Protest-cum- Complaint Case no. 766 of 2015 from the cause title of the petitioner; as he has died. Considering the facts of the case, the prayer is allowed. Registry is directed to delete the Opp. Party no. 2 from the array of the Opp. Parties of this petition and re- number the present Opp. Party no. 1 as the sole Opp. Party with Red Ink. CrMP No. 3326 of 2025 This criminal miscellaneous petition has been filed at the instance of the petitioners for restoration of CrMP no. 3325 of 2021 to its original file. Learned counsel for the petitioner submits that the CrMP no. 3325 of 2021 was dismissed for non-prosecution vide order dated 28.08.2025. Learned counsel for the petitioners submits that due to inadvertence, the conducting counsel could not appear in court when the case was called out, which resulted in dismissal of CrMP no. 3325 of 2021. It is further submitted that the petitioner has very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that CrMP no. 3325 of 2021 be restored to its original file. Learned Addl. P.P. has no serious objection for the prayer of restoration. Considering the aforesaid submission of the learned counsel for the petitioner, CrMP no. 3325 of 2021 is restored to its original file to the stage, at which, it was before its dismissal.
