Pandey, learned counsel for the petitioner as well as Mr. Anmol Sharma, learned Panel Lawyer, appearing for the State/respondents. 2 The instant writ petition is preferred by the petitioner under Article 226 of the Constitution of India with the following relief(s):- “10.1 That this Hon'ble court may kindly be pleased to restrain the respondent authorities to not make any construction/not made any other activities/not dispossess the petitioner from the subject land till the final decision of the application for grant of Van Adhikar Patta of the subject land. 10.2 That, this Hon'ble court may kindly be pleased to direct the respondent no 3 to consider/decide the application of the petitioner for grant of Van Adhikar Patta of the subject land. 10.3 That, any other relief or reliefs may also be granted to the petitioner which this Hon'ble court deems fit and proper in the facts and circumstances of the case.” 3 3 Learned counsel for the petitioner submits that instant writ petition is filed against the illegal, arbitrary and unreasonable action on the part of respondent authorities, by which they have illegally marking the subject land for construction of the Pahadi Korwa Asharam building, in which the petitioner is in possession since last 75 years and is doing the agricultural operations since last 40 years. He further submits that as per circular issued by the State Government, petitioner is eligible for grant of Van-Adhikar Patta of subject land and he has filed an application for grant of lease/Van- Adhikar Patta on 06.06.2022, which is yet to be decided. As such, a direction be given to the respondent authorities to consider and decide his application within a specific time frame. 4 On the other hand, learned counsel appearing for the State/respondents fairly submits that the application of the petitioner for grant of lease/Van-Adhikar Patta will be decided expeditiously. 5 Having heard the learned counsel for the parties as well as considering the overall facts and circumstances of the case, the respondent authorities, particularly respondent No.3, i.e., Collector Balrampur, District Balrampur-Ramanujganj, Chhattisgarh is directed to consider the application of the petitioner for grant of lease/Van-Adhikar Patta in respect of subject land bearing Khasra Nos.122/1, 122/2, 46/1, 46/2, Rakba 0.08, 0.09, 0.37 and 0.38 Hectares respectively at village Balrampur and decide the same 4 within a period of two months from the date of production of certified copy of this order.
