THE HON’BLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No. 16998 OF 2024 ORDER:
The Writ Petition is filed questioning inaction of the respondents in withholding the amounts of Rs.3,89,104/- vide M Book No.91/2022-23, Rs.68,486/- vide M Book No.143/2021-22 and Rs.88,508/- vide M Book No.185/2020-21, even after finalizing the bills payable to the Petitioner in relation to works i.e., “1. Repairing of potholes in various places in secretariats from 22 to 29 at Chilakaluripet Municipality, vide Agreement No.269/2022-23, dated 02.01.2023, 2. Construction of balance CC Drain at Jalaiah colony 2nd Line 9th ward in Chilakaluripet Municipality, vide Agreement No.28/2023-24, dated 07.06.2023 and 3. Supply and Delivery of 450 mm dia MS Pipe for water supply maintenance in Chilakaluripet Municipality, vide Agreement No.94/2023-24 dated 11.07.2023”.

When the matter is taken up for hearing, the learned Standing Counsel passed on written instructions received by him, signed by the Commissioner, Chilakaluripet Municipality, wherein it was mentioned at paragraph No.4 that the Petitioner had executed the works as stipulated under agreement referred above and that the payment could not be made due to lack of funds. It was further mentioned that the Municipality will be paying the amounts as and when the amounts are released, without any delay.
3. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of works and the amounts due

to the Petitioner, this Court is inclined to dispose of the Writ Petition with the following direction:
(i) The Respondents are directed to pay the amounts due to the Petitioner within a period of four (04) months from the date of receipt of the copy of this order.
There shall be no order as to costs. Consequently, miscellaneous applications, if any, pending shall stand closed. _____________________ NYAPATHY VIJAY, J
