Shri Mahant Ramratan Das Management Trustee Shri Ramdham Ramkuti Seva Trust, Village Machwa, Tehsil And District Jaipur (Raj.) ----Respondents For Petitioner(s) : Mr. R. S. Bhardwaj For Respondent(s) : HON'BLE MR. JUSTICE SUDESH BANSAL Order 25/02/2025 1. Petitioner has preferred instant civil writ petition under Article 227 of Constitution of India, assailing the order dated 03.10.2023 passed by the Commissioner Devasthan Department, dismissing his application under Order 1 Rule 10 CPC and declining to implead the petitioner as party in the appeal filed by and on behalf of respondent No.1-Shri Rampaldas Ji Charitable Trust against registration of a Public Trust in the name of " Shri Ramdham Ramkuti Seva Trust at village Machwa, Tehsil and District Jaipur" permitted by the Assistant Commissioner-I Devasthan Department, Jaipur Division, Jaipur vide judgment dated 03.01.2013. 2. Commissioner Devasthan Department has clearly observed in the order impugned that the petitioner is claiming right of [2025:RJ-JP:8453] (2 of 2) [CW-1002/2024] worship in the Temple of Trust, alleging himself to be the Chela of Shri Ramkripal Das Maharaj and since same is a civil right, petitioner is at liberty to establish his right before the Civil Court. It has been observed by the Commissioner that the scope of present appeal is confined to the registration of Public Trust on the application filed by Shri Ramratan Das and since the application filed by Sangat Singh was dismissed, hence he has filed appeal thereagainst. 3. In addition, it has also been observed that the appeal was filed way back in the year 2013 being appeal No.16/2013 and the application has been filed by the applicant on 16.08.2022. 4. Having considered the reasonings assigned by the Commissioner Devasthan Department to dismiss the application of petitioner, this Court does not find any illegality, perversity or jurisdictional error in the order impugned, warranting interference by this Court in exercise of power under Article 227 of the Constitution of India, as has been observed by the Commissioner Devasthan Department in the order impugned that it is open for the petitioner to establish his right of worship in the Temple of Trust, hence declining his impleadment in the present appeal does not lead to any miscarriage of justice. 5. With aforesaid observations, the writ petition is hereby dismissed. 6. Stay application and any other pending application, if any, also stand disposed of. (SUDESH BANSAL),J TN/13
