Date : 10/07/2025 ORAL ORDER By way of present petition under Article 226 of the Constitution of India, the petitioner has prayed for the direction to the respondent Nos.2 and 3 to form SIT to conduct the investigation agresh in connection with FIR being CR No.7/2023 registered with ACB Police Station, Vadodara City lodged by the petitioner. Learned APP tenders the report dated 10.07.2025 submitted by Mr. A.N. Prajapati, Police Inspector, ACB Police Station, Vadodara City which is taken on record. Perusing the report dated 10.07.2025 it appears that the allegations made by the petitioner are thoroughly investigated and looked into. Learned APP has pointed out that though the petitioner has been summoned five times to join the investigation, the petitioner has failed to turn up to join the investigation and has not provided any material however, it is kept open to collect evidence to establish the chain of evidence in connection with the allegation made by the

Even, further investigation under Section 173(8) of the CrPC is going on and further it is assured that if in future any evidence is collected or made available against the proposed accused then, after getting the permisison from the competent Court, the investigating agency will proceed further with the matter and at present further investigation is going on. Considering the aforesaid fact, at this stage, no case is made out to issue any direction in exercise of powers under Article 226 of the Constitution of India as this Court is prima facie satisfied with the report submitted by the Police Inspector, ACB Police Station, Vadodara City. Hence, present petition is disposed of. If in future any evidence or material is collected and petitioner is aggrieved or dissatisfied with the further investigation then it is kept open for the petitioner to file appropriate proceeding if so advised. It is made clear that this Court has not gone into the merits of the case.
