JUSTICE ARUN DEV CHOUDHURY O R D E R 04.12.2025 Heard Mr. Sentiyanger, learned counsel for the petitioner. Also heard Mr. Veto V. Zhimomi, learned Public Prosecutor for the State of Nagaland. 2. The present application under Section 482 of the BNSS has been filed by the petitioner/accused praying for grant of anticipatory bail to the Page No.# 2/2 applicant in connection with the Diphupar Police Station Case No. 57/2024 under Section 406/420 IPC (GR 489/2024). A Coordinate Bench, by Order dated 19.11.2025, granted interim protection to the petitioner with a condition that the petitioner shall cooperate with the investigating agency. 3. Learned Public Prosecutor has produced the Case Diary. Perused the same. From the Case Diary it is seen that subsequent to the interim order dated 19.11.2025, the petitioner appeared before the Investigating Officer. He was thoroughly interrogated and was released on interim bail. 4. Also perused the statements of the witnesses recorded by the Investigating Officer during the course of investigation. Perusal of the Case Diary as well as taking note of the conduct of the accused in cooperating with the investigating agency this Court is of the opinion that custodial interrogation of the petitioner may not be necessary for further investigation of this case. Accordingly, the present bail application stands allowed in terms of the interim order dated 19.11.2025 with a further condition that the petitioner shall appear before the Investigating Officer as and when called for and he will cooperate with the investigation and shall not tamper or hamper and influence any witnesses that may be vital for the investigation. 5.
