Neutral Citation No. - 2025:AHC:29166 Court No. - 34 Case :- WRIT - C No. - 6184 of 2025 Petitioner :- Virendra Pratap Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Ravi Shanker Pathak Counsel for Respondent :- Azad Rai,C.S.C. Hon'ble Manish Kumar Nigam,J. 1. Heard learned counsel for the parties and perused the record. 2. The instant writ petition has been filed for following relief: "i) Issue direction in the nature of mandamus to direct the respondent authority to not established the Tubewell in Gata No. 175 Mauza Alawalpur, Pargana & Tehsil Soraon, District Prayagraj, it is made clear that the Gata No. 175 belongs to the petitioner and the respondent authority wrongly mentioned in the Gata No. 175 is Naveen Parti instead of Gata No. 179 Mauza- Alawalpur, Pargana & Tehsil- Soraon, District- Prayagraj." 3. From perusal of the record, it is apparent that there is a dispute as to Gata No.179 recorded in the name of the petitioner and Gata No.175 recorded as Navin Parti. The claim of the petitioner is that name of the petitioner has been wrongly recorded over Gata No.179 which should have been recorded as Navin Parti and the name of the petitioner ought to have been recorded in Gata No.175. It appears that this wrong entry has been made as per the petitioner in view of the orders passed by the Consolidation courts. 4. Learned Standing Counsel has submitted that revision filed by the petitioner under Section 48 of the U.P. Consolidation of Holdings Act against the judgment and order dated 04.10.1991 in Appeal No.2403 is pending before the District Deputy Director of Consolidation, District Prayagraj. 5. No useful purpose would be served in keeping this petition pending. 6. Let the District Deputy Director of Consolidation, District Prayagraj be directed to decide the revision filed by the petitioner being Revision No.738 of 2023 (Virendra Pratap Singh Vs. Land Management Committee) expeditiously, preferably within a period of four months from the date of production of a certified copy of this order after giving opportunity of hearing to the parties concerned provided that there is no other legal impediment. 7. With these observations, the writ petition stands disposed of. Order Date :- 3.3.2025 S. Singh (Manish Kumar Nigam,J.) Digitally signed by :- SAVITA SINGH High Court of Judicature at Allahabad
