Order No. 02
Dated 18th September, 2025
Heard the learned counsel for the respective sides.
This appeal is directed against the order dated 31.07.2025 passed in Bail Petition No. 172 of 2025 arising out of Sahibganj (Town) P.S. Case No. 74/2025 by the learned Sessions Judge, Sahibganj, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that two miscreants had sprayed the son of the informant with bullets which resulted in his death.
Submission has been advanced by the learned counsel for the appellant that though the First Information Report was instituted against unknown persons, but subsequently on the basis of CDR, Manish Kumar Mandal and Kush Kumar Mandal were apprehended to have been the persons who were involved in firing at the son of the informant. Learned counsel further submits that there has been recovery of arms and ammunitions on the confession of the said co-accused persons and so far as the present appellant is concerned, his name has transpired in the confessional statement of co-accused Chhanguri Rajjak @ Chutra who is alleged to have sold a firearm as well as two cartridges to the present appellant from whom the same was recovered. Learned counsel adds that the appellant is in custody since 08.05.2025.
Learned APP has opposed the prayer for bail of the appellant.
On consideration of the fact that the main allegation of committing the murder is against Manish Kumar Mandal and Kush Kumar Mandal and
so far as the present appellant is concerned only a firearm and two cartridges were recovered from his possession which was not used in the commission of the murder, we while setting aside the order dated 31.07.2025 passed in Bail Petition No. 172 of 2025 arising out of Sahibganj (Town) P.S. Case No. 74/2025 by the learned Sessions Judge, Sahibganj, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sahibganj in connection with Sahibganj (Town) P.S. Case No. 74/2025.
This appeal is allowed.
