CRMPM-2846 of 2025 By way of instant application filed under Section 5 of Limitation Act, prayer has been made on behalf of the applicant/petitioner for condonation of delay in maintaining the accompanying criminal revision petition, which is barred by limitation. Having carefully perused the averments contained in the application, which are duly supported by an affidavit, this Court finds no impediment in accepting the prayer, especially when delay caused in maintaining accompanying criminal revision petition does not appear to be intentional or willful, rather same has occurred on account of circumstances, which were completely beyond the control of the applicant, as such, the same deserves to be condoned. In view of above, delay, which has been otherwise sufficiently explained is condoned. The application is disposed of. Cr. Revision No. _______ of 2026 (CR.RST-10050 of 2023) Be registered. Notice to respondent be issued, returnable within four weeks, on taking steps within one week. Cr.MP No. of 2026 (CRMPST No. 10051/23) Notice in aforesaid terms. In the meantime, substantive sentence imposed by the learned Court below shall remain suspended, subject to applicant’s depositing 50% of compensation amount, which shall also include amount, if any, already deposited and furnishing personal bonds in the sum of Rs. 20,000/- (rupees twenty thousand only) with one surety in the like amount to the satisfaction of the learned trial Court within a period of six weeks, with condition that the applicant shall appear in the court as and when directed and shall surrender to serve out the sentence imposed, in case the revision is ultimately dismissed.
