Heard Mr. P. Surien, learned counsel for the petitioner and Ms. Inaholi, learned Government Advocate, Nagaland.

This writ petition was preferred to assail an Order dated 05.06.2025 passed under Section 3[1] of the Prevention of Illicit Trafficking in Narcotic Drugs and Psychotropic Substances [PIT-NDPS] Act, 1988, which Order was subsequently confirmed. By an Order dated 06.09.2025, the order of preventive detention was extended with effect from 07.09.2025 to 06.12.2025.
3. In an Order dated 06.12.2025 passed by the respondent no. 1, it is observed that the circumstances for detention of the detenu no longer exist. By the Order dated 06.12.2025, the respondent no. 1 in exercise of the powers conferred by Clause [A] of sub-section [1] of Section 12 of the PIT-NDPS Act, has directed that the detenu be released forthwith from detention and he is to be tried for the case registered against him as per law.
4. In view of the direction to release the detenu, there is no surviving cause of action to proceed further with the writ petition. Due to the Order dated 06.12.2025, the writ petition has been rendered infructuous and it is accordingly closed.
