BEFORE HON'BLE MR. JUSTICE UNNI KRISHNAN NAIR ORDER 27.11.2025 Heard Mr. Sentiyanger, learned counsel for the petitioner who submits on instructions that he be permitted to withdraw the present writ petition with liberty to approach the appropriate forum under the provisions of the Arbitration and Conciliation Act, 1996, praying for grant of interim reliefs pending conclusion of the arbitration proceeding underway between the parties. The learned counsel for the petitioner also prays for grant of 15 (fifteen) days time to approach the competent forum and till such time the interim orders operating in the matter be continued. In view of the above, the present writ petition stands dismissed on withdrawal with liberty to the petitioner to approach the competent forum
Page No.# 3/3 under the provisions of Arbitration and Conciliation Act, 1996 for claiming reliefs. In the event such proceedings are instituted by the petitioner within 15 (fifteen) days from today, the interim directions passed by this Court vide Order dated 18.08.2025 shall continue to operate. However w.e.f. the 16th day, from today, the interim directions passed vide order dated 18.08.2025 shall not be subsisting. This Court has extended the interim directions only to facilitate the petitioner to institute proceedings and not to suffer any prejudice in the interregnum, however, such extension of orders shall not be binding upon the Court considering the application filed by the petitioner and such application shall be so considered by it on its own merits.
