GUNESHWAR SHARMA ORDER 27.10.2025 [1] Present Mr. M. Hemchandra, learned sr. counsel assisted by Mr. M. Rendy, learned counsel for the petitioner; Mrs. O. Momota Devi, learned sr. counsel assisted by Mr. Th. Luckyboy, learned counsel on behalf of the respondent no. 3; Mr. R.K. Umakanta, learned GA for the respondent no. 4; Mr. N. Ibotombi, learned sr. counsel along with Mr. A. Rommel, learned counsel for the respondent no. 5; Mr. L. Shashibhushan, learned sr. counsel assisted by Ms. L. Liya, learned counsel for the respondent nos. 2 & 7; Mr. R.K. Deepak, learned sr. counsel for the respondent no. 1 & 6. [2] The present contempt petition arises for non-compliance of the order dated 02.09.2024 passed by this Court in W.P. (C) No. 822 of 2023 whereby, the State respondent especially Education (S) Department was directed to furnish draft rules i.e. Recruitment Rules of Primary Physical Education Teachers, Undergraduate (PET), Graduate (PET) Lecturer and 6 (six) week’s time was granted for complying the order and sent the draft rules to the MPSC for OINAM THOIBA MEITEI Digitally signed by OINAM THOIBA MEITEI Date: 2025.10.30 11:01:58 +05'30' speeding the whole exercise and shall be completed within a period of 6(six) week’s from the date of receipt of the order. Since, the order has not been complied, the petitioner filed Contempt Cas(C) No. 137 of 2024 as there was changed in the incumbent Officers, respondent nos. 4, 5, 6 & 7 were impleaded later on. [3] Mr. R.K. Deepak, learned sr. counsel for the respondent nos. 1 & 6 submits that one more incumbent is yet to be impleaded. [4] Vide order dated 24.09.2025, this Court observed that if the earlier direction is not comply, this Court directed the concerned Officers to appear before this Court on 28.10.2025 at 10:30 a.m. [5] In the circumstances, respondent nos. 2 & 7; 5; 1 & 6; 3; 4 filed MC(Cont. Cas(C)) No. 112 of 2025, MC(Cont. Cas(C)) No. 114 of 2025, MC(Cont. Cas(C)) No. 115 of 2025, MC(Cont. Cas(C)) No. 116 of 2025, MC(Cont. Cas(C)) No. 117 of 2025 & MC(Cont. Cas(C)) No. 119 of 2025 for dispensing in the personal appearance of the respondents as well as for recalling of the order dated 24.09.2025. In MC (Cont. Cas(C)) No. 116 of 2025, the Administrative Department i.e. Education (S) Department has stated in para no. 5, a timeline where the Administrative Department has taken steps for compliance of the direction of this Court. It is stated that the draft rules was submitted to the Department of Personnel and Finance Department, Govt. of Manipur and the Department of Personnel (in short DP) returned the draft rules with certain suggestions and after that 3(three) draft rules i.e. for Primary teachers (PET), Graduate teachers (PET) and Lecturer in Physical Education have been framed as advised by the DP and the same has been submitted to the DP and Finance Department, Govt. of Manipur. The DP has no objection to the latest amended draft rules. [6] However, Mr. R.K. Deepak, learned sr. counsel for the respondent nos. 1 & 6 submits that the Administrative Department is awaiting the view of the Finance Department and after obtaining the view of the Finance Department the matter will be placed before the Government counsel and after obtaining approval from the Govt. counsel the matter will be forwarded to the MPSC for its view. [7] Mr. N. Ibotombi, learned sr. counsel appearing on behalf of the respondent no. 5 submits that the incumbent Secretary for Finance Department stated that 3(three) week’s time may be given for the Finance Department to peruse the draft rules and give its view to the Administrative Department. [8] Mr. M. Hemchandra, learned sr. counsel for the petitioner has pointed out that the order was passed in the year, 2024 and has not been complied till date. In the circumstances, this Court may take serious view of the non-compliance. [9] This Court is of the opinion that even though there is delay on the part of the State respondent in complying the case order, some progress in the view of the Finance Department is obtained, the matter may be forwarded to the MPSC after getting approval from the Govt. counsel. In the circumstances, 3(three) week’s time is granted to the Finance Department for submitting its view to the draft rules submitted by the Education (S) Department and after obtaining the view of the Finance Department, the same be forwarded to the MPSC. MPSC shall give its view within 2(two) month’s on the submission of the proposal by the Administrative Department after necessary papers of the Administrative Department. [10] Personal appearance of the parties are dispensed with. However, the application being MC (Cont. Cas(C)) No. 115 of 2025 for recalling of the order dated 24.09.2025 is rejected.
