ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity £the BNSS') by the petitioner/Accused No.13 for granting of pre-arrest bail in connection with Crime No.16 of 2025 of C.Belgal Police Station, KurnooI District, registered for the alleged-offences,punishable under Sections 191 (2),191 (3),118 (1),109 (1),126 (2) and 351 (2) read with 190 of the Bharatiya Nyaya Sanhita, 2023 (for brevity {the BNSJ)
2. The case of the prosecut'lon is that on 01,02.2025 at about 6.30 hours, the Accused Nos.1 to 16 formed themselves into a.n unlawful assembly armed with deadly weapons and attacked the de-faCtO complainant with an intention to kill him, and beat him W'lth Sickle on head and caused bleeding injuries and also attacked his father-jn-law and caused bleeding injuries. All the accused threatened the de-facto complainant with dire consequences. 3. Sri P.Narasimhulu, the learned counsel for the petitioner, submits that the petitioner has not committed any offence; he was falsely implicated in this case; he is the sole breadwinn.er of'his family; he is ready to abide `` ..---

Per con£ra, Ms. P.Ak-lla Naidu, the learned Assistant Public Prosecutor, opposed in granting of bail stating that investigation is not yet completed; if the petitioner is granted pre-arrest bail, he will repeat the same offence; the petitioner/Accused No..13 was already involved in another two crimes i.e., Cr.No.145 of 2021 & Cr.No.07 of 2023 and urged to dismiss the bail petition. 5. Perused the record. 6. As seen from the averments in the statement given by the `de-factO complainant, there are no specific overt acts attributed to the pet'ltioner/Accused No.13. AIthough it is mentioned that the petitioner was I a member of the unlawful assembly, no specific allegation is levelled against him. The petitioner is a permanent resident of Bramhana Doddi + Village, C. Belagal Mandal, KurnooI District, and has a fixed abode. 7. Considering the nature of the allegations leveled against the petitioner/Accused No.13, his alleged role played in this case, this Court deems it fit to grant pre-arrest bail to the petitioner/Accused No.13. 8. ln the result, the Criminal Pet-ltion is allowed with the following . ` conditions: l a _

In the event of his arrest, the petitioner/Accused No.13 shall be enlarged on bail subject to he executing a personal bond for a sum of Rs.20,000/I- (Rupees .Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials; ii. The petitioner/Accused No.13 shall make himself available for investigation as and when required; iii. The petitioner/Accused No.13 shall notcause any threat, inducement or promise to the prosecution witnesses; iv. The petitioner/Accused No.13 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charg'e sheet. v.
