IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No.13393 of 2025
Date of Decision: 21.8.2025 _____________________________________________________________________ Kairon
……...Petitioner Versus State of Himachal Pradesh & Ors. …....Respondents
Coram
Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting?
For the Petitioner: Mr. Adarsh K. Vashista and Mr. Shivom Vashista, Advocates.
For the respondents: Mr. Anup Rattan, Advocate General with Mr. Rajan Kahol, Mr. Vishal Panwar and Mr. B.C. Verma, Additional Advocates General and Mr. Ravi Chauhan, Deputy Advocate General. ___________________________________________________________________________
Sandeep Sharma, J. (Oral)
Petitioner, who at present is working as JBT in GPS Batot, Education Block Gehra, District Chamba, Himachal Pradesh, has approached this court in the instant proceedings, seeking therein direction to the respondents to decide his representation (Annexure P- 3), whereby prayer has been made by him to transfer him from afore station to District Kangra, Himachal Pradesh, under 5% inter-district quota on the ground that wife of the petitioner is suffering from blood cancer.
2.
Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for reply from the respondents, who are otherwise represented by Mr. Vishal Panwar, learned Additional Advocate General. Mr. Panwar,
2
states that since petitioner has not completed normal tenure at present place of posting, he cannot claim transfer under 5% inter- district quota, but he fairly states that on account of adverse family circumstances, representation, if any, of the petitioner, if not already decided, shall be decided in accordance with law.
3.
Having taken note of the aforesaid fair stand adopted by learned Additional Advocate General, this Court, without going into the merits of the case, deems it fit to dispose of the present petition with direction to the respondents/competent authority to decide the pending representation having been filed by the petitioner (Annexure P-3), expeditiously, preferably, within three weeks. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass a speaking order thereupon taking note of transfer policy, which provides for adjustment of an employee, on account of adverse family circumstances. Pending applications, if any, also stand disposed of.
