Case of{he `prosecutiOn, in brief, iS that, On 28.5.2025 at 6,00am, on receipt of cred'lble information about illegal possession and transportation of ganja, the s.I of police, secured the presence of his staff and mediators and rushed to Brick kilns, Balaramunipeta and .found seven persons in suspicious circumstances. On seeing police, they tried to escape. Then police apprehended them and On enquiry, they disclosed their identity particulars as that of Al to A7 and police found 4kgs of ganja in their possession. Then police arrested the accused, seized the contraband and other material and sent the accused to Court for judic-lal remand. 4. Learned counsel for the petit'lOner COntended that even according {o the case of the prosecution, the petitioner was arrested when himself along with others were found in possess'lon of 4 kgs of ganja, which iS non-commercial quantity and the petitioner has been languishing in jail from 29.5.2025 and prays to allow the Criminal Pet'ltiOn. 5. On the other hand, learned Assistant Publ'lc Prosecutor opposed for grant of bail to the petitioner but fairly conceded that the contraband seized is small quantity. 8. Learned COunSel for the Petitioner Submitted that the COntraband alleged to be seized from the possession of the petitioner and others is 4kgs of ganja Which iS not COmmerCial quantity. The peti['IOner has been languishing in judicial custody from 29.5.2025 and the Petitioner iS a permanent resident of Machilipatnam. As the contraband Seized iS not Of commercial quantity, no reasons need to be recorded as contemplated under section 37 of the NDPS Act, Most of the Witnesses are Shown tO be official witnesses and the release of the accused would not cause hampering of investigation.
As most Of the inVeSt',gatiOn might have been completed and the petitioner has permanent abode and there is no possibi''lty of his fleeing away from justice, as such, this court is inclined to'grant bail to the petitioner. ll. ln the result, the Criminal Pet'ltiOn iS allowed With the fOllOW|lng conditions'. i.
