Neutral Citation No. - 2025:AHC:27006 Court No. - 1 Case :- CONTEMPT APPLICATION (CIVIL) No. - 853 of 2025 Applicant :- Committee Of Management Shamshabad School Committee And Another Opposite Party :- Narendra Pal Singh, District Inspector Of School Counsel for Applicant :- Umair Mahmood Hon'ble Salil Kumar Rai,J. The present contempt application has been filed pleading willful disobedience of the order dated 23.01.2020 passed by this Court in Writ - C No. 1394 of 2020. It appears from a reading of the order dated 23.01.2020 and from the averments made in the affidavit as well as by the contents of different documents annexed with the affidavit that certain orders were passed by the Deputy Registrar under the Societies Registration Act recognizing particular office bearers of the Society. The order of the Registrar was stayed by this Court in Writ C No.1394 of 2020 on the allegations that the membership of the Society which was necessary to recognize the office bearers of the Society had to be decided by the Civil Court and the Civil Court had accepted the claim of the petitioners/applicants, a factor which the Registrar had ignored in his order. Consequently, this Court vide order dated 23.01.2020
directed that the Management of the Educational Institution governed by the Society shall not be altered on the basis the
order impugned in the petition. The present application has been filed pleading willful disobedience of the order passed by this Court alleging that the District Inspector of Schools has passed an order for elections of the management of the institution on the basis of the list of members registered before the Registrar. The order dated 14.8.2024 passed by the District Inspector of Schools does not alter the management of the Society and further the applicant shall always have the remedy to challenge the elections of the Management of the Educational Institutions as well as the attestation of the
signatures of the elected candidate, in case, there is any irregularity or illegality in the elections. It is not a case to register proceedings under the Contempt of Courts Act, 1971. The application is dismissed.
