This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest in connection with Hariharpur P.S. Case No.25 of 2022, for offences under Sections 408, 420, 468, 471 and 120-B IPC. The case is presently pending before the Court of learned Judicial Magistrate, 1st Class, Dhanbad. 3. Learned Spl. P.P. opposes the prayer for anticipatory bail. 4. There is an allegation that the petitioner being an employee of Bharat Finance Inclusion Limited, has defalcated the amount from the investors. It is alleged that without the knowledge of the beneficiaries, the petitioner and others have withdrawn huge amount illegally and misappropriated the same. So far as this petitioner is concerned, the amount of defalcation is to the tune of Rs.1,77,860/-. 5. Considering the fact that the petitioner has defalcated the money from poor investors, this is not a fit case for grant of 2025:JHHC:15153 2 anticipatory bail to the petitioner. 6. Accordingly, this Anticipatory Bail Application stands dismissed. 7. I.A. No.4657 of 2025 filed for early hearing of the matter, is rendered infructuous, as the matter has been taken up today.
