The petitioners are apprehending their arrest in connection with Dhanbad RPF Post Case No. 18 of 2025, registered for the alleged offence under Section 3 of R.P.(U.P.) Act, pending in the Court of learned Railway Judicial Magistrate, Dhanbad. 3. Learned counsel appearing for the petitioners submits that the name of the petitioners has been disclosed by the apprehended co- accused and nothing has been recovered from the possession of the petitioner. He submits that the petitioners are having the criminal antecedent. 4. Learned A.P.P. appearing for the State and learned CGC appearing for the Railway jointly opposed the prayer and submit that there are six criminal antecedents against them of the identical nature [2025:JHHC:27128] -2- and that has been disclosed by the petitioners themselves. 5. In view of the above and considering that the petitioners are having the criminal antecedents and further they have already been served the notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioners, above named, are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on the appropriate terms and conditions or on sureties as may deem fit and proper by the learned Court.
