Mr. Tejasvi Sharma and Mr. H.S. Rawat, Additional Advocates General, for the respondents/State. The present application has been moved in CWP No. 16462 of 2024, which was allowed by this Court on 08.08.2025. While allowing the said writ, the following reliefs were granted to the applicant:- “ (i) Order, dated 31st January, 2025 (Annexure R-5), rejecting the request of the petitioner for parole, is quashed and set-aside; (ii) Respondents are directed to extend the concesion of parole to the petitioner, for a period of 42 days, on his furnishing a personal bond in the sum of Rs. 1,00,000/-, with two sureties in the like amount, to the satisfaction of Superintendent Sub Jail Kishanpura, Nalagarh, District Solan, H.P.; (iii) The petitioner shall also undertake that he shall not cause any threat or inducement to the child victim and the complainant, nor, try to contact them, in any manner. He will not reside in the house, where, the complainant and the child victim are residing and will reside along with his parents. (iv) It is made clear that the petitioner shall surrender before Superintendent of Sub Jail, Kishanpura, Nalagarh, District Solan, H.P., on expiry of parole period. In case, the petitioner breaches any of the conditions of parole, then, the respondents are free to concel the parole and take action against the petitioner, in accordance with law; (v) In peculiar facts and circumstances, of the case, the respondents are at liberty to impose any other just and reasonable condition(s), in addition to the conditions mentioned hereinabove, if deemed fit and proper, to meet the ends of justice; (vi) Violation of any of the above conditions shall be treated as a negative factor for consideration of similar prayer, in future.” By way of present application, a prayer has been made to modify the condition No. (ii), by virtue of which he was directed to furnish a personal bond in the sum of Rs. 1,00,000/-, with two sureties in the like amount, to the satisfaction of Superintendent Sub Jail Kishanpura, Nalagarh, District Solan, H.P., on the ground that the applicant is a poor person and unable to arrange for two sureties. Considering the said fact, condition No. (ii) in the order dated 08.08.2025, is modified and the same shall now be read as under:- “(ii) Respondents are directed to extend the concesion of parole to the petitioner, for a period of 42 days, on his furnishing a personal bond in the sum of Rs. 1,00,000/-, with one surety in the like amount, to the satisfaction of Superintendent, Sub Jail Kishanpura, Nalagarh, District Solan, H.P.” Application is disposed of, accordingly.
