Heard Mr. Laknyei Phom, the learned counsel appearing on behalf of the petitioner and Mr. A. Sangtam, the learned counsel appearing on behalf of the respondents. 2. The petitioner herein has filed the instant writ petition being aggrieved by the inaction on the part of the respondent authorities in not granting her an appointment on compassionate ground under the establishment of the Directorate of Municipal Affairs, Kohima. 3. It is relevant to take note of that the State of Nagaland has an Office Memorandum dated 17.09.2015 whereby a Scheme has been formulated for compassionate appointment for the State Government employees who die in harness. Admittedly, the petitioner’s husband had expired while in service, and as such, the petitioner is entitled to be considered for compassionate appointment. 4. Mr. A. Sangtam, the learned counsel appearing on
Page No.# 3/4 behalf of the respondent State submits that the petitioner’s case has been duly considered and at present, the petitioner is at Sl. No.1 in the list so prepared and in that regard has produced before this Court a tentative waiting list for appointment on compassionate ground under the Directorate of Municipal Affairs, Kohima wherein the name of the petitioner has been reflected at Sl. No.1. 5. Mr. A. Sangtam, the learned counsel appearing on behalf of the respondents further submits that upon vacancy arising which is specifically assigned to the compassionate appointment as per the Scheme dated 17.09.2015, the petitioner would be duly appointed as she is at Serial No.1. 6. Taking into account the above, nothing further remains in the instant writ petition to be adjudicated. 7.
Before parting, this Court observes and directs that the respondent authorities shall duly pass orders for appointment of the petitioner in terms with the Office Memorandum dated 17.09.2015 more particularly when the petitioner is at Sl. No.1 of the tentative waiting list for compassionate ground under the Directorate of Municipal Affairs, Kohima. 8. The said document which was placed before this
