2. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor for the respondent/state. perused the record. 3. Originally, the petitioner herein fI-led a petl'tion for grant ofregular bail in crime No.77 of 2025 of Gopalapatnam police station. By an
Order, dated o5.05.2025, the learned Special Judge for Trial of offences under the NDPS Act, Visakhapatnam allowed the said petition by imposing certain conditions. Aggrieved by the said conditions imposed by the learned special Judge, the petitioner herein filed the present criminal petition to modify the conditions l'mposed by the learned Special Judge a{ the time of granting bail.
4. It is submitted that despite grant of bail on o5.05.2025 by the learned Special Judge, the petitioner could not furnI'Sh Sureties for Rs.50,000/- with two sureties to the satisfaction of the learned lI Additional chief Judicial Magistrate, visakhapatnam. He further contends that the petitioner belongs to a poor family, eking out his livelihood by doing coolie work and due to the said reason, the petitioner js unable to furnish the sureties for Rs.50,000/-, and though bail was granted on o5.05.2025, the petitioner could not furnish the , sureties and has been languishing I'n jail and requests the Court to consider his case on humanitarian grounds.

5. In viewofthe aforesaid facts and circumstances of the case, this Court is inclined to modify I.he condition imposed in the order dated 05.05.2025 in Crl.M.P.No.1131 of 2025 passed by the learned Special Judge.
6. ln the resu_lt, the criminal petitI'On iS allowed and the petitioner herein shall be released on bail on his execution of personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties each for the like sum each to the satisfaction of the learned ll Additional Chief Judicial Magistrate, Visakhapatnam. It ,is made clear that the other conditions imposed by the learned Special Judge, shall remain same. Miscellaneous applications, pending if any, shall stand closed.
