Karri kalyan Durga Prasad SC FOR TUDA The Court made the following: THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.16411 of 2025 O R DE R: The present writ petition is filed declaring the action of Respondent Nos.4 to 9 in seeking to form road in Petitioner’s private patta land in Sy.Nos.230-9, 230-10 and 232-4, 5 & 6 situated at Mittapalluru, ward of Puttur Municipality, Puttur Mandal, Tirupati District without initiating proceedings under land acquisition as illegal and arbitrary. Petitioner claims to be the owner of the schedule property 2. referred above and relies on revenue records to substantiate his case. As there was threat of laying of road without the consent of the Petitioner, the present writ petition is filed. Learned Assistant Government Pleader on instructions 3. submits that the Petitioner is actually having Ac.0.97 cents in Sy.No.230/9A in an extent of Ac.0.54 cents in Sy.No.230/1OA totalling to Ac.1.51 cents. He stated that out of the said land, an extent of Ac.0.09 cents was sold by the predecessors of the Petitioner vide registered sale deed in favour of the villagers vide Document No. 1615 dated 04.11.1982. It is also stated that the Petitioner is only having Ac.1.42 cents in both the survey 2 numbers. Learned Assistant Government Pleader further submits that during the enquiry by the Office of the Tahsildar, Puttur Mandal, the katcha road is being used by the two villages of Mattapalluru and Mittapalluru AAW as there is no alternative access road to the villages, the road was also being used by the Petitioner. 4. Learned standing counsel for Urban Development Corporation submits that further action of laying of road for development purpose would be taken up by the Corporation only after getting the lands verified from the revenue department. Learned standing counsel further submits that the road formation was started and dumped the gravel and spread up to 70 meters length, but on the representation made by the Petitioner, the Respondent-Corporation has stopped the work. After confirmation of the classification and ownership of the lands from the Revenue Department, the road work will be taken up following due process of law. 5. In the light of the submissions of the learned standing counsel, the writ petition is disposed of with the following directions: 3 ¥ (i) The Petitioner shall approach the Respondent-authority explaining the source of title to the property along with relevant documents. (ii) On such submission, the Respondents shall consider and proceed further in accordance with law. (iii) No order as to costs. As a sequel, pending applications, if any, shall stand closed.
