This is third bail application seeking grant of bail to the Applicant who is in jail since 12.05.2024 in connection with Crime No.185/2024 registered at Police Station Kusmunda for the offence punishable under Section 293 IPC and Section 12 of POCSO Act. 2. The first bail application of the applicant was dismissed on merits on 28.06.2024 in MCRC No.3751 of 2024. The second bail application was dismissed on 24.10.2024 in MCRC No.7470 of 2024. 3. Learned Counsel for the applicant would submit that the applicant is in jail since 12.052024, offence of Section 293 IPC is bailable and offence of Section 12 of POCSO Act is having maximum sentence of 3 years 2 whereas and applicant is behind bar for more than one year and therefore he may be enlarged on bail. 4. On the other hand the counsel for the State opposes the bail application. 5. Considering the submissions made by the counsel for the parties, considering the nature of offence and the allegation against the applicant, two bail applications have already been rejected earlier and also considering the fact that trial of the case is in progress and witnesses are regularly examined, I do not find any change in circumstances. 6.
