No.17162 of 2023 The Court made the following: ORDER This Writ Petition under Article 226 of Constitution of India is filed for the following relief: “…to issue an appropriate writ order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents No.2 to 5 in not renewing the petitioners commission agent licence bearing No. 140-A / 2014- 2019 for further period even though a representation dated 12.06.2023 was submitted by the petitioner as illegal, arbitrary, contrary to the Andhra Pradesh (Agricultural Produce and Live stock) Markets Act, 1966 as amended by the Act 14 of 2015 and Rules made thereunder, violation of principles of natural justice and contrary to the Articles 14, 19(1)(g) and 21 of the Constitution of India and pass such other order or orders which this Court deems fit in the interest of justice”. 2. The case of the petitioner is briefly as follows:- The learned counsel for the petitioner requested to dispose of the petition directing the respondents to pass appropriate order on the representation dated 12.06.2023 as per law or permit the petitioner to submit afresh representation on issue of Form-C by the respondent No.4. 3. Sri T.Raghu, Assistant Government Pleader for Agriculture representing the respondent No.1 and Sri G.Rajeswara Rao, learned Standing Counsel for Agriculture Marketing Committee representing 3 BSB, J W.P. No.17162 of 2023 respondent No.4 submitted that the application would be processed only as per law, as the petitioner has not been doing business in the market yard due to which licence cannot be renewed to provide steps for other ryots who are willing to conduct business. 4. In view of the above submissions, the writ petition is disposed of directing the petitioner to submit within one month an application afresh for grant of licence afresh by following due procedure of law and thereafter, within two (02) weeks the respondent No.4 shall take appropriate decision.
