JUSTICE ANJAN MONI KALITA O R D E R 24.10.2025 Heard Mr. Pakinrichapbo, learned counsel for the accused/applicant. Also heard Ms. Livika, learned Public Prosecutor for the State. 2. This is an application under Section 482 of the BNSS, 2023 for Page No.# 2/3 granting pre-arrest bail to the accused/applicant in connection with GR No. 07/2024 registered under Section 21(b) NDPS Act, 1985 pending before the learned Special Judge, NDPS Act, Longleng District, Nagaland. 3. The learned PP appearing for the State submits that Charge-Sheet in the instant matter has already been submitted vide Charge-Sheet No. 64/2024 dated 10.12.2024 before the learned Special Judge, NDPS, Longleng, Nagaland. In view of the aforesaid she submits that nothing survives in the matter and the accused/applicant should be directed to appear before the concerned Court, i.e., the learned Special Judge, NDPS, Longleng, Nagaland. 4. Whereas the learned counsel appearing for the accused/applicant submits that he should be given some interim relief so that he can appear before the learned Special Judge, NDPS, Longleng, Nagaland. It is also submitted by the learned counsel that other accused persons, who have been Charge-Sheeted are already on bail. 5. In view of the aforesaid submissions and taking into account that Charge-Sheet has already been filed, this Court is of the view that the accused/applicant should be given the benefit of pre-arrest bail so that he can appear before the learned Special Judge, NDPS, Longleng, Nagaland. In view of the aforesaid, it is directed that in the event of the arrest of the accused/applicant by the investigating authority, the accused/applicant shall be granted interim pre-arrest bail on furnishing a bail bond of Rs. 30,000/- (Rupees Thirty Thousand only) with a surety of a Government servant with the following conditions: Page No.# 3/3 (i) That the accused/applicant shall appear before the learned Special Judge, NDPS, Longleng, Nagaland within 2 (two) weeks of passing of the instant Order. (ii) That the accused/applicant shall cooperate with the investigation and make himself available before the investigating authority and the learned Special Judge, NDPS, Longleng, Nagaland as and when called for. (iii) That the accused/applicant shall not try to tamper or hamper with the investigation process in the instant matter. 6. In view of the aforesaid directions this instant pre-arrest bail application is disposed of as allowed. JUDGE Comparing Assistant
